§1 Eligibility to participate

1. By registering for the Tradity stock market game, the user expressly agrees to the following conditions of participation.
2. Only persons who have reached the age of 14 are eligible to participate.
3. There is no legal entitlement to participate in the Tradity stock market game.

§2 Registration

1. The user warrants that all data provided by him/her during registration (first name and surname) is true and complete. The user is obliged to notify Tradity immediately of any changes to their user data or to update the relevant data immediately, in particular the user’s e-mail address provided during registration. In this regard, Tradity reserves the right to block the user account or to exclude the user from further participation if the user cannot be reached repeatedly via the e-mail address provided.
2. The user participates in the stock market game with a pseudonym. This may not have any reference to (glorifying) violence or be associated with gambling or criminal activities. In the event of a violation, Tradity reserves the right to change the pseudonym accordingly or, if necessary, to block the user account or exclude the user from participating in the stock market game.
3. The user warrants that he/she is at least 14 years of age at the time of registration.
4. Each user may only register once. Since Tradity cannot technically determine with certainty whether a user who is already registered with Tradity is not registered twice, Tradity expressly reserves the right to check the accuracy of the user’s details both in the event of suspicion and by means of random checks (e.g. by means of the Post-Ident procedure); if the user refuses to provide proof of identity, Tradity also expressly reserves the right to block the user account or terminate membership.
5. By registering, the user agrees to be contacted by Tradity via the e-mail address provided and to receive the Tradity newsletter. The newsletter can be canceled.

§3 Obligations of the user

1. When using the content and services on the Tradity websites, the user is obliged to comply with the applicable laws and the rights of third parties in addition to these Terms of Use.
2. The user undertakes not to express any punishable content in and with comments made by him.
3. Any infringement shall justify immediate exclusion by blocking the account and termination of membership.

§4 Liability

1. Tradity does not guarantee the uninterrupted availability of data and accepts no liability for technical faults affecting the accessibility of Tradity’s services.
2. Furthermore, Tradity may use a freely determined period of time for technical work.
3. The course information is provided by Tradity for private use only without any guarantee of completeness, correctness or accuracy.
4. Any content on Tradity expressly does not constitute investment advice or any other recommendation.
5. Tradity does not express any opinion of its own, in particular no investment or financial advice or recommendation. Liability for losses arising from securities transactions is hereby expressly excluded.
6. The Tradity websites contain links to other websites whose content cannot be influenced by Tradity. Tradity is neither liable for the accuracy and content of these websites nor for services/products offered via these websites.
7. The user indemnifies Tradity against all claims asserted by other users or other third parties against Tradity due to an infringement of their rights by the content posted by the user on the Tradity websites. The user shall also indemnify Tradity against all claims asserted by other users or other third parties against Tradity due to the infringement of their rights by the user’s use of the services of the Tradity websites. All further rights of Tradity remain unaffected.

§5 Final provisions

1. Tradity reserves the right to change the conditions of participation as well as the system of the stock exchange game and the structure of the website at any time without giving reasons.
2. The user can submit all declarations to Tradity by e-mail to team@tradity.de. Tradity can send declarations to the user by email, which the user has stored as current contact details in their user account. The user is responsible for actual availability.
3. Should provisions of the Terms and Conditions of Participation or a provision included in it in the future not be legally effective in whole or in part or lose their legal effectiveness or feasibility at a later date, this shall not affect the validity of the remaining provisions of the Terms and Conditions of Participation. The same applies if it should turn out that the conditions of participation contain loopholes. In place of the invalid or unenforceable provisions or to fill the gap, an appropriate provision shall apply that comes closest to what Tradity would have wanted.
4. Tradity reserves the right to change the rules and conditions of participation at any time. The changes will be published at boersenspiel.tradity.de on the “Conditions of Participation” page and will be binding for all users from the time of publication. Original regulations to the contrary are thereby replaced and become invalid.
5. Tradity is entitled to terminate the stock market game at any time and without compelling reason. The weekly and main prizes will then no longer be awarded.
6. Users who, in the opinion of Tradity, have indications of manipulative behavior (e.g. so-called bugusing) will be excluded from further participation in the stock market game without prior hearing or consultation. If the user has won a weekly or main prize due to manipulative behavior, the player’s entitlement to win expires. In such cases, winnings may also be subsequently disallowed and reclaimed.
7. Students are eligible to win. In city competitions, only pupils from participating schools are eligible to win.
8. Each participant can only be the official weekly winner once in each competition. If a participant wins more than once during a competition season, the next person in line will move up.
9. Legal recourse is excluded.
